I honestly can't believe it's come to this. I had some flooring work done a few years back and financed it through the store. I hit some tough times and fell behind on payments, but I thought we had worked something out over the phone. Now I've just been handed a court summons and I'm completely panicking.
The paperwork says I only have a certain number of days to respond or they'll get a default judgment against me. I've never been sued before and I have no idea how this works. Do I need to show up in court? Can I still settle this before it goes that far? I'm terrified they're going to start garnishing my wages.
What really worries me is I don't have any of my original paperwork from when I bought the flooring. I don't even remember the interest rate or the full terms. I'm scared they're adding on a bunch of fees and interest that I never agreed to.
I've been reading about debt validation and how collectors have to prove they own the debt, but does that apply once you're already at the lawsuit stage? Has anyone here gone through a court case with this company? Did you get a lawyer or did you represent yourself?
I know I owe something, but I just want to make sure the amount is correct and that I'm not getting taken advantage of. Any advice from someone who's been in my shoes would be so appreciated. I feel sick to my stomach just thinking about this.
